Who is this visa for?
This visa is for spouses or de facto partners of Australian citizens, permanent residents, and eligible New Zealand citizens. This visa requires the visa applicant to be offshore (outside Australia) for lodgement; however, as of November 2023, you can be located outside Australia at the time of grant.
Basic Eligibility Criteria:
Be in a genuine relationship with your spouse or de facto partner who is an Australian citizen, permanent resident or eligible New Zealand citizen
Have your spouse or de facto partner sponsor you
Be outside Australia when you apply for this visa. The family who applied with you must also be outside Australia
Be in or outside Australia when we decide on your temporary visa application. (As of November 2023)

Subclass 309: Offshore Partner Visa Requirements
Genuine Relationship
You must be in a genuine and continuing relationship with your partner.
Over 18 Years Old
You must be over 18 years of age to apply as either the sponsor or applicant.
Australian Citizen
The sponsor must be an Australian citizen or hold permanent residency.
Financial Support
The sponsor must show that they can financially support their partner.
Good Character
Both the applicant and sponsor must show good character at the time of the application.
Met in Person
You should have met and spent time together in person.

Subclass 820/801: The applicant must be in Australia at the time of application
Subclass 309/100: The applicant must be outside Australia at the time of application.
As of November 2023, the applicant is allowed to be in or outside Australia at the time of grant.

We suggest you budget around $14–17k for an Subclass 309/100 application.
Government Lodgement Fee: $8850 for the main applicant, additional dependents are extra.
Professional Fees: $5000-$7000
(As of March 2024)
Please note that the overall amount is not payable upfront.

We request that professional fees be paid upon signing your professional services agreement.
The government lodgement fee can be paid within 5 days of lodgement.
Both payments can be made using a credit card. (Subject to a Department imposed 1.50% surcharge)

While its possible to lodge the application on your own, its not really advisable to do so. It really depends on the complexities of your case.
Unfortunately, we often get approached to help someone who has received a refusal.
It is very difficult to assist clients that have received a refusal, as they often have a very short time limitation to lodge another application.
Because of this, we strongly recommend that you engage a Lawyer or agent to assist you in the preparation of your partner visa.

Some character issues do preclude you from sponsoring/being sponsored.
There are many considerations when it comes to the character requirement, and individual, tailored advice is critical in such circumstances.
