Subclass 300 Prospective Marriage Visa

Who is this visa for?

This visa is for those who are engaged to marry an Australian and wish to enter Australia to marry their fiancé. This visa must be lodged offshore.

This visa requires that the couple have met in person at least once and that they intend to marry in Australia within 9 months of the visa grant.

Once the couple has married, their next step will be to apply for a Subclass 820 Onshore Partner Visa while in Australia.

Basic Eligibility Criteria:

  • Be in a genuine relationship with your spouse or de facto partner who is an Australian citizen, permanent resident or eligible New Zealand citizen

  • Be engaged to your partner

  • Be outside Australia when you apply for this visa

  • Be outside Australia at the time of the decision

Subclass 300: Prospective Marriage Visa Requirements

Genuine Relationship

You must be in a genuine and continuing relationship with your partner.

Over 18 Years Old

You must be over 18 years of age to apply as either the sponsor or applicant.

Australian Citizen

The sponsor must be an Australian citizen or hold permanent residency.

Financial Support

The sponsor must show that they can financially support their partner.

Good Character

Both the applicant and sponsor must show good character at the time of the application.

Be Engaged, Not Married

Ideally, you should be engaged, not married. Upon approval, you can get married.

  • The Subclass 300 Prospective Spouse visa is for couples that want to get engaged prior to relocating to Australia.

  • We suggest you budget around $14–17k for a Subclass 300 Prospective Marriage Visa.

    Government Lodgement Fee: $8850 for the main applicant, additional dependents are extra.

    Professional Fees: $5000-$7000

    (As of March 2024)

    Please note that the overall amount is not payable upfront.

  • We request that professional fees be paid upon signing your professional services agreement.

    The government lodgement fee can be paid within 5 days of lodgement.

    Both payments can be made using a credit card. (Subject to a department-imposed 1.50% surcharge)

  • While its possible to lodge the application on your own, its not really advisable to do so. It really depends on the complexities of your case.

    Unfortunately, we often get approached to help someone who has received a refusal.

    It is very difficult to assist clients that have received a refusal, as they often have a very short time limitation to lodge another application.

    Because of this, we strongly recommend that you engage a Lawyer or agent to assist you in the preparation of your partner visa.

  • Live, stay, work, and study.

    Travel to and from Australia as many times as you want.

    Apply for access to Australia’s public health care scheme, Medicare.

  • Some character issues do preclude you from sponsoring/being sponsored.

    There are many considerations when it comes to the character requirement and individual, tailored advice is critical for such circumstances.

  • It generally takes 1-3 months to prepare the paperwork from engagement to lodgement.

    However, our firm is able to lodge with much shorter timeframes if required.
